Local Transfer Plan

Conversion of Statements of Special Education Needs (SEND) or Learning Disability Assessments (LDA's) to Education Health & Care Plans (EHCP)

Note: all Bradford Council Statements of SEND and LDA's have now all been transferred and converted into EHCP as a statutory requirement.

Consultation

Professionals were consulted about the transition arrangements at a series of meetings held across the District in the Spring Term 2014. A series of separate events, organised by the Bradford and Airedale Parents Forum were held in the spring and summer of 2014 to consult with parents and carers. There was unanimous support for the conversion reviews to take place using the end of key stage as a model.

Numbers

Bradford Council maintains approximately 2200 statements of special educational needs. This means that during a 3 year transition period approximately 680 conversion reviews will be held during each academic year.

In addition, Bradford Council has issued approximately 260 'Learning Difficulty Assessments'. These will be reviewed by August 2016.

The Transfer or Conversion Review

BMDC will convert existing Statements and LDAs to Education, Health and Care Plans over the next three and half years, in accordance with the statutory guidance 2014.

'Transitional and Saving Provisions (made under section 137 of the Children and Families Act 2014) relating to part 3 of the Children and Families Act 2014 (children and young people in England with special educational needs or disabilities – DfE 2014)’

The transition process, which includes a needs assessment, is the responsibility of the Local Authority with support from schools and settings. The school or setting, on behalf of the Local Authority, will inform the parent/carers of the intention to carry out a 'Conversion' review at least two weeks before the review is due to take place. The review documentation will include any new or updated evidence of SEN and will be submitted to the Local Authority officers. The SEN Officers will produce a draft EHC plan within 14 weeks. Parents will receive a copy of the draft and will be offered the opportunity to meet with a local authority SEN Officer to finalise the plan.

“No child or young person should lose their statement and not have it replaced with an EHC plan simply because the system is changing.”

The table below indicates the academic year in which the transfer review will take place. The actual date of the review will be communicated by the school or setting.

In addition, children and young people with a Statement leaving custody between 1 September 2014 and 1 April 2015 will have a transfer review.

Children and young people with Statements will continue to have an Annual Review as normal during this transition period.

Information for parents, carers and young people including the transfer review process

In July 2014 Bradford Council informed all Special Educational Needs Co-ordinators (SENCos) at schools and settings of the due dates for the conversion reviews.
